Federal Legal Status
Polymarket is federally legal in the United States as of November 2025.
In July 2025, Polymarket acquired QCEX, a CFTC-regulated derivatives exchange and clearinghouse. In September 2025, the CFTC issued an "Amended Order of Designation," officially recognizing Polymarket as a Designated Contract Market (DCM). This is the highest regulatory approval available to a US futures exchange.
The CFTC regulates prediction market contracts as derivatives under the Commodity Exchange Act. Like crude oil futures or Treasury bond options, prediction market contracts are financial instruments, not gambling.
Polymarket officially relaunched US operations in December 2025, though with limited availability through a waitlist system and KYC (Know Your Customer) requirements. This represents a massive shift from 2022 when the CFTC fined Polymarket $1.4 million and forced it to block all US users.
State-Level Complications
Federal approval doesn't guarantee access everywhere. Several states argue that prediction markets on sports outcomes constitute illegal gambling under state law, even if the CFTC calls them derivatives.
Massachusetts: Issued a preliminary injunction in early 2026 blocking Kalshi (Polymarket's competitor) from offering sports contracts. The court ruled that event contracts on sports results function as illegal sports wagering. Polymarket has geoblocked Massachusetts residents, though the company might challenge this ruling.
Nevada: The Nevada Gaming Control Board filed a lawsuit in January 2026 claiming Polymarket violates state gaming law. The board argues that state gaming authority should regulate these markets, not the CFTC. The lawsuit is ongoing.
Tennessee: Sent cease-and-desist orders, claiming Polymarket violates gaming laws and tax requirements. A federal judge temporarily blocked enforcement, but the case continues.
Other states: Over 19 states have taken action against Kalshi as of January 2026. Most haven't explicitly sued Polymarket yet, but the regulatory environment is hostile in some regions.
Polymarket's Response
Rather than fight state-by-state, Polymarket geoblocks states with explicit restrictions. If you're in Massachusetts, Polymarket blocks you. If you're in Nevada, restricted functionality applies.
The company's strategy: comply where forced, operate freely where regulators are silent, and hope federal authority eventually preempts state gambling laws. The Supreme Court hasn't ruled yet, so uncertainty remains.
International Status
Polymarket is banned in several countries:
- Switzerland: Blacklisted for gambling law violations - France: Forced to geo-block after regulatory pressure - Singapore: Added to gambling blacklist in January 2025 - Poland: Ministry of Finance blacklisted the platform - Belgium: Gaming Commission banned Polymarket in February 2026
Most countries haven't taken formal action.
